Virginia Step Parent Adoption Lawyer

When a parent remarries, it is often the case that the step parent becomes more of a parent to the child than the other birth parent. When this happens, it may be in the child’s best interests to be adopted by the step parent. Step parent adoption is the most common form of adoption. If the absent parent has had little contact with the child and is willing to sign a consent, then the process can be relatively simple.

When Legal Issues Arise, Even Step Parent Adoptions Can Become Complicated

If the absent parent cannot be found, or is not willing to sign a consent, it is still possible for the adoption to be completed. Virginia law authorizes a judge to grant a step parent adoption without the consent of the birth parent if the judge determines that the consent is being withheld contrary to the best interests of the child. This often involves a trial at which time evidence is presented upon which the judge will make this important decision.

Virginia Putative Father Registry

Virginia now has a Putative Birth Father Registry. The law places a burden upon a man who may have fathered a child to register if he wants to protect his parental rights. If a birth father's identity is known, he must still receive notice of the adoption proceeding. If he cannot be found after using due diligence, then he may be served by publishing notice in a local newspaper.
